TEWALT SHAFER, COBLESKILL - Dated:
7 June 1834. Probated: 23 February 1835.
WILLS OF REAL ESTATE, 1832 - 1842, Book A, Pages 62,63; Book on file at the
Schoharie County Surrogate's Office, Schoharie, NY.
The last will and testament of
Tewalt Shafer, of the Town of Cobleskill, in the county of Schoharie and State
of New York.
I Tewalt Shafer considering the uncertainty of this mortal life, and being
of sound mind and memory (blessed by Almighty God for the same) do make and
publish this my last will and testament, in manner and form following (that
is to say)
First I give and bequeath to
my eldest son Barney Shafer, the farm or lot or lots of land now in his possession
and upon which he now resides, lying and being in the town of Cobleskill aforesaid,
and situate on the public highway between Henry Foxes and Andrew Mickell (be
the same more or less) for ever.
I further give and bequeath unto
my two younger sons Peter T. Shafer and David I. Shafer the whole of the old
farm, upon which I now reside (containing about one hundred and twenty eight
acres of land be the same more or less) to be equally divided between them
(excepting out of the aforesaid old farm, a certain house and lot of half
an acre of land now occupied by Daniel Smith and his wife Elizabeth) to have
and to hold the aforesaid old farm, their heirs or assigns forever.
I further give and bequeath to
my daughter Elizabeth, wife of Daniel Smith, the aforesaid house and lot of
half an acre of land during her natural life and after her death to go to
my two sons Peter T. Shafer and David I. Shafer (to be equally divided between
them) forever.
I further give and bequeath to
my son Jacob Shafer five dollars to be paid to him, by my two sons Peter T.
Shafer and Daniel I. Shafer on demand - I further give and bequeath to my
Rebecca, wife of Philip Foland, an outfit equal to the outfit given my other
daughters and fifty dollars in cash to be delivered and paid to my said daughter
Rebecca, by my two sons Peter T. Shafer and Daniel I. Shafer, equally between
them, the fifty dollars to be paid in one year after my decease -
Also I give and bequeath to my
beloved wife Elizabeth (in addition to her third of my Real estate during
her natural life) all my plate and household goods, bedsteads and bedding
and other household furniture, to go to my daughters after her death according
to her direction -
And lastly, all the rest and
residue of my personal estate whatever and wheresoever the same may be and
not herein before given and disposed of, I do give and bequeath to my two
sons Peter T. Shafer and David I. Shafer to have and to hold for their benefit
absolutely -
And it is my will and order that
my two Sons Peter T. Shafer and David I. Shafer pay all my debts due or to
become due at my decease -
And I do hereby appoint my Son
Barney Shafer, Henry Shafer, Jun, Abraham Mann, Executors of this my last
will and testament - and lastly my express will and meaning is, and I do hereby
order and appoint that if any differences, dispute, question, or controversery
shall be moved, arise or happen concerning any gift, bequests matter or thing
in this my will, given and bequeathed, expressed or contained, that then no
suit or suits in law or equity or otherwise shall be brought commenced or
prosecuted, for or concerning the same; but the same Shall be referred wholly
to the award, order and determenation of my Said Executors, to wit, my Son
Barney Shafer, Henry Shafer Junior, and Abraham Mann (all of Cobleskill aforesaid)
and what they Shall order; direct or determine therein Shall be binding and
conclusive to all and every person or persons therein concerned - And I do
hereby revoke allgormer wills by me made-
In witness whereof I have hereunto set my hand and seal the seventh day of June in the Year of our Lord one thousand, eight hundred and thirty Four-

Signed, Sealed, published and declared by the above name Tewalt Shafer, to
be his last will and testament, in the presence of us who have hereunto subscribed
our names as witnesses in the nresence of us who have hereunto subscribed
our anmes as witnesses in the presence of the testator - Martin Shafer - Ira
Glazier, Alexander Mann.
